ASSIGNMENT BRIEF
When writing this assessment reference is to be made to laws discussed in the module,
both CASE LAW and LEGISLATION, where applicable. Discuss all answers fully and
where different or alternative legal solutions are possible, all must be explored.
This is an INDIVIDUAL assessment and is equivalent to TWENTY PERCENT (20%) of total
module marks.
Answer should be written in approximately 1000 WORDS, with in-text citation and
references using decisions of the courts, statutes, textbooks, and other publications. A
reference list must be included at the end of the paper. The word-count should be
reflected on the cover page of the assignment and does not include the reference list.
Referencing should be Harvard style where appropriate. Where case law and legislation
are used, legal referencing Oxford Standard should be observed. Papers without
citations and references would NOT be accepted.
Proper page margins, 1.5 Spaces, Arial or Times New Roman, 12 Font, Justified, and
pagination, should be used. Failure to observe these requirements could mean a
reduction of marks.
Grammar and expression are taken into account when assessing answers.

SCENARIO
Tina saw an advertisement on a newspaper which reads: “For sale, a new, original,
limited edition, LV handbag, for £3,000. This is the most stylish bag in the market today.
Please call or visit LV Xchange shop if interested”.
Tina called LV Xchange on 12 April and said that she is interested but needs to know if
the handbag is the only one of this kind being sold in the shop. The shop manager,
Winnie, replied that they only have one and that the bag is a limited edition with only 9
handbags created for all LV Xchange shops worldwide. Tina said that she needs to see
the item first before she decides to buy and asks if Winnie can keep the handbag for
her until the next day. Winnie promised that she would not sell the bag and would keep
it for Tina until the next morning.

Candice also read the advertisement on the papers and went to the shop to see the
handbag advertised. Winnie showed her the handbag. Candice asked if the price
includes insurance cover. Winnie replied it does not. Candice said she will buy the bag
for £2500 since it is not insured.

Meanwhile, another customer Susie who was in the shop told a salesperson that she
would buy the handbag only if it really was limited edition. The salesperson told her
that there are only 9 bags of that kind made by LV. Because of that statement Susie
decided to buy the handbag. She was given a receipt for her purchase.

Susie was excited to use her new and expensive handbag but when her friends saw it
they told her that it was not stylish at all. Besides, Susie discovered that the handbag is
available on many High Street shops. Susie wants to return the bag and get her money
back but she was told that it is not possible. The shop manager told Susie to check the
receipt she was given. Written on the receipt that LV Xchange give to customers is a
statement which reads ‘Items may NOT be returned unless defective.’ The manager said
that the handbag was not defective.

Tina went to the shop the next morning but the handbag has already been sold.
Candice said that she was willing to buy the bag for £3000.
